1. General
This privacy statement is applicable to the processing of personal data by:

Winger takes the protection of your personal data seriously and takes appropriate measures to prevent abuse, loss and unauthorised access, publication and modification of your personal data. Within Winger, your personal data are only accessible to those who strictly need them in the execution of their function. Winger processes your personal data in accordance with the applicable legislation, as well as with the provisions related to direct marketing in Book XII of the Belgian Code of Economics and the obligations set out in Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereafter: GDPR). In this privacy statement Winger clarifies which of your personal data it processes, for which purposes and based on which legal grounds, how long your personal data are being stored, to whom your personal data can be transferred and which rights you have with regard to the processing of your personal data.
2. What is personal data?
The GDPR defines personal data as follows: “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.
3. Which personal data does Winger process, for which purpose and on which legal basis?
Aside from the collection and processing of personal data you (occasionally) provide Winger via phone call or use of the Winger website, Winger collects and processes personal data of the following data subjects in the context of its activities:
- (potential) Clients and their employees
- People who subscribe to the newsletter
- People who provide Winger with their business card or provide their personal data otherwise
- Job applicants
- Service providers
- Third parties (insofar this is necessary for the execution of a task entrusted to Winger by a client)

- Personal characteristics
- Professional data (profession and job title)
- Other personal data provided by (potential) clients, for example in correspondence or by telephone, or in the context of requested services

4. How long does Winger store your personal data?
Winger processes your personal data no longer than is strictly necessary for the purposes for which they were collected:
- Client and service provider management (execution of assignments): 10 years after the contract has ended
- Direct marketing: 3 years after the last meaningful contact, on the understanding that renewal of the term is possible upon your consent
- Job applicants: 1 year after reception of the personal data
5. Who can Winger transfer your personal data to?
The personal or corporate data provided by you can be transferred by Winger to:
- Winger Patents bv or Winger Trademarks bv respectively
- Related companies
- Service providers acting as processors for Winger: IT service providers, PR/marketing service providers, …
- Professional consultants providing advice to Winger like law firms and accountants
- Banks and insurance companies Winger works with
- Third parties involved in services provided by Winger to their clients: foreign agents, external authorised people, other experts, …
Lastly, Winger can also transfer your personal data to third parties in case of a legal obligation or on request of the police or judicial authorities, or in case you consented to this. Your personal data will not be sold, nor rented, distributed or otherwise made commercially available to third parties. In the context of organising events, your personal data (name and surname for example) can be transferred to external parties who organise the events. This solely for organisational reasons and/or for safety reasons.
6. What rights do you have with regard to the processing of your personal data?
You have a fundamental right of access to your personal data, request a copy of them and have them corrected or erased. Aside from this, you have the right to withdraw any consent or object to the processing of your personal data by Winger (for example for marketing purposes) and you have a right to data portability.
You can file a request to exercise your right of access, correction, erasure or data portability, withdraw your consent or object to the processing of your personal data to the following e-mail addresses: patents@winger.eu (for Winger Patents bv) and trademarks@winger.eu (for Winger Trademarks bv) or via registered mail to the above mentioned postal addresses of Winger Patents bv and Winger Trademarks bv respectively.
Winger engages to react as quick as possible, and this within 30 days, to your request.
You need to consider the fact that Winger occasionally is not obligated to comply with your request to erasure, correction, erasure or data portability.
Winger wants to indicate that you have the right to file a complaint with the national supervisory authority, the Belgian Data Protection Authority. Before filing a complaint, it is recommended to contact Winger to find a quick solution to your problem.
7. Amendments to the privacy statement
Winger reserves the right to amend this privacy statement at any time. The most recent version will always be displayed on our website. In case of any substantial changes, Winger will inform you of this via their website, per e-mail or regular mail.
